Fourth Amendment Affirmed: Location Privacy Win In the Courts Requires Warrants For Cell Phone Location Records

In a highly anticipated ruling, the Third Circuit Court of

Appeals in Philadelphia held that federal law gives judges

the discretion to require the government to obtain a

probable cause search warrant before accessing cell phone

location data and that location information about private

spaces, such as the home, may be protected by the Fourth

Amendment.
