Oklahoma Ban on International & Shari'ah Law Defended by U.S. Border Control




SPRINGFIELD, Va., Nov. 17, 2010 /PRNewswire-USNewswire/ -- U.S. Border Control and U.S. Border Control Foundation filed an Amicus Curiae brief in the United States District Court for the Western Division of Oklahoma in opposition to the Plaintiff's motion for a temporary restraining order (TRO) to stop certification of a constitutional amendment, State Question 755.



The amendment ensures that Oklahoma courts "shall uphold and adhere to the law as provided in the United States Constitution, the Oklahoma Constitution, the United States Code, established common law, the Oklahoma Statutes, and rules promulgated thereto," but shall not look to the legal precepts of other nations or cultures. Specifically, the courts shall not consider international law or Shari'ah law.



On November 4, 2010, the plaintiff, a self-described "practicing Muslim," with the assistance of CAIR (the Council on American-Islamic Relations) sought a temporary restraining order to prevent the Oklahoma State Board of Elections from certifying passage of 755.



"In Europe, radical Islam and Shari'ah Law are causing terrific problems. In U.S. cities where large Muslim populations exist, attempts are being made to replace our own laws, including our Constitutional guarantees of Freedom of Speech and Religion, with Shari'ah," said Edward Nelson with U.S. Border Control.



Shari'ah seems to defend brutal behavior that treats women like cattle; condones violence; and denies freedom of speech and religion to anyone who is not a Muslim. That's a problem for a nation that respects the rights of women and serves as a bastion for freedom of speech and religion.



In New Jersey, a man who brutalized his wife, torturing her and raping her, used Shari'ah Law as his defense. The Defendant claimed he was operating under his belief that, as a husband, his desire to have sex when and whether he wanted to, was something that was consistent with his practices and it was something that was not prohibited.



America has always welcomed immigrants with very diverse backgrounds, languages, cultures and religions. All we ask is that they obey our laws and treat their fellow Americans with respect. In my mind, Shari'ah fails this test on all counts and poses a grave threat to American's freedoms.
